R (on the application of AR) v Chief Constable of Greater Manchester Police and another [2016] EWCA Civ 490, [2016] All ER (D) 100 (Jun)

The Court of Appeal upheld the dismissal of the claimant’s claim for judicial review challenging the lawfulness of a reference to an allegation and to an acquittal of a criminal charge in an enhanced criminal record certificate. What had occurred had not amounted to a violation of art 6(2) of the European Convention on Human Rights, in that, taken as a whole, the issue of the certificate had not undermined the claimant’s acquittal and, further, art 8 of the Convention had not been breached.
