There is a lot of activity currently in the arena of equal pay litigation, with six separate group actions being brought against major retailers

In this week’s NLJ, Charles Pigott, professional support lawyer, Mills & Reeve, explores the first substantive ruling to emerge—last month’s employment tribunal decision in Thandi v Next Retail and another.

He writes: ‘Case law shows that it is not possible to justify indirect discrimination based on purely financial factors.’

Pigott looks at the issues and reasoning in the case, as well as the wider picture on equal pay, including government plans to extend protection.
