In his lecture on 7 March 2017 Lord Justice Jackson raised the proposal that “the optional fixed recoverable costs rules which apply to Aarhus cases might be developed and applied more generally to judicial review claims”. He expressed the hope that this would be considered at the London and Cardiff seminars. At the London seminar on 13 March two of his assessors (Vikram Sachdeva QC and Nicholas Bacon QC) developed the proposal, which was well received by the audience. Many people spoke in favour, including Martin Westgate QC the chairman of the Administrative Law Bar Association. During the seminar, at Jackson LJ’s request, Mr Westgate agreed to form a working group to look into the details.
