Appeal fee levies

Immigrants refused leave to remain or to enter the UK will have to pay the costs of their appeals under Ministry of Justice (MoJ) proposals.

Currently, the MoJ pays the cost of appeals to the Immigration and Asylum Chambers, with funds raised partly through visa fees. However, it now proposes to charge fees of about £125 for oral hearings, £65 for paper hearings and £250 for appeals to the Upper Tribunal, where appellants are capable of supporting themselves. Asylum appeals and appeals against action initiated by the state will be exempt. Individuals in receipt of legal aid will have their fees paid by legal aid.
