The Tomlin order came under fire in a recent Court of Appeal case, former District Judge Stephen Gold reports in this week’s Civil Way.
Gold looks at the implications of the case and predicts the courts will hear ‘from a multitude of debtors willing to suffer the embarrassment of asserting that the pre-Tomlin defence they had put forward was devoid of merit or their belief in its contents, notwithstanding their statement of truth’.
