
Writing in this week’s NLJ, Charles Pigott, professional support lawyer, Mills & Reeve, investigates how the EU law thread in the landmark judgment on deductions in holiday pay can be applied to the rest of the UK.
Pigott asks, secondly, where Angew will stand ‘once the general principles of EU law have been excised from UK law by the EU Retained Law (Revocation and Reform) Act 2023.
For example, the 2023 Act provides that ‘no general principle’ of EU law is part of domestic law after the end of 2023. Pigott writes: ‘The Act does not define the general principles of EU law referred to, but they almost certainly include the principle of equivalence and the Marleasing principle, both of which were deployed in Agnew.’
