Westcott v Westcott [2008] EWCA Civ 818, [2008] All ER (D) 193 (Jul)

A person who makes a complaint to the police, thereby instigating a police investigation which does not lead to a prosecution, is entitled to rely on the defence of absolute privilege if defamation proceedings are subsequently brought.
