Intermark Srl v Office for Harmonisation in the Internal Market (Trade Marks and Design) T-384/13, [2015] All ER (D) 192 (Mar)

The General Court of the European Union dismissed the action brought by Intermark Srl (Intermark) against the decision of the Second Board of Appeal of the Office for Harmonisation in the Internal Market (Trade Marks and Designs), relating to opposition proceedings between The Coca-Cola Company and Intermark regarding the application by Intermark for registration of a figurative sign “Cola” as a Community trade mark.
