The defendants were charged with wounding with intent contrary to s 18 of the Offences Against the Person Act 1861. The form of the indictment was defective in that it did not spell out the mental element of the offence in the usual manner.
HELD It did not follow that the indictment failed to give reasonable information as to the nature of the charge, as required by r 14.2(1) of the Criminal Procedure Rules.
