Charter plc v City Index Ltd [2007] EWCA Civ 1382, [2007] All ER (D) 361 (Dec)

Liability for “knowing receipt” is within the scope of the Civil Liability (Contribution) Act 1978.

Therefore, a person who is liable as a knowing recipient of funds transferred in breach of trust may seek a contribution from any other person responsible for damage to the party defrauded.
