The Court of Appeal, Civil Division, in dismissing the defendant’s appeal, held that s 41 of the Trade Marks Act 1994 was compatible with Parliament and Council Directive (EC) 2008/95 and rejected the argument that the trade marks in issue in the present case were liable to be declared invalid.
