Société Des Produits Nestlé SA v Cadbury UK Ltd [2016] EWHC 50 (Ch), [2016] All ER (D) 159 (Jan)

The Chancery Division considered the findings of a hearing officer in a dispute concerning the registration of a trade mark of a similar shape to the Kit Kat product owned by the applicant, Nestle, and disputed by the respondent company, Cadbury, in the light of the responses received from questions put to the Court of Justice of the EU. The court held that the hearing officer had not erred in his findings.
