Firms investigating the behaviour of partners need to pay special attention to the area of document creation, says Frank Maher, partner of Legal Risk. They may need to disclose these to a variety of agencies such as the police, Information Commissioner or HMRC as well as insurers, accountants and clients. Moreover, while the partner being investigated remains a member of the firm, he or she may be entitled to copies of any documents created.
