A lawyer’s reputation is separate from the goodwill generated by their work, the High Court has held. The decision clears Yorkshire law firm Taylor Bracewell of passing off by using former partner Juthika Bhayani’s name to promote its employment offering, using the brand name “Bhayani Bracewell” as well as a trademark for the name. Bhayani objected to the firm’s continued use of her name after she left the firm. The court held that the firm retained the goodwill, in Bhayani v Taylor Bracewell [2016] EWHC 3360 (IPEC).
