LNB NEWS: MoJ publishes toolkit to help families access funds of disabled young people

The Ministry of Justice (MoJ) has published a toolkit which aims to increase awareness of the Mental Capacity Act 2005 (MCA 2005) and help parents and carers access funds belonging to disabled young people, should they lose the capacity to make decisions themselves. 

Lexis®Library update: The guide was created in response to a government consultation published in February 2023 and marks the first step in fulfilling the government’s pledge to tackle barriers to accessing savings.

Developed with the support of parents, carers and charities, the toolkit will provide guidance on changes in decision-making responsibility when a young person who lacks mental capacity transitions into adulthood, the relevant route to make financial decisions on behalf of a young person and how to prepare to make financial decisions for when a person turns 18.
