LNB NEWS: MoJ implements extended fixed recoverable cost regime

The civil justice minister, Lord Bellamy KC, has announced at the Civil Justice Council National Forum that the Ministry of Justice (MoJ) plans to implement the extended fixed recoverable costs (FRC) regime in October 2023. 

Lexis®Library update: Discussions on finalising the new rules that strive to implement the FRC extension were continued at the Civil Procedure Rule Committee (CPRC) meeting on 2 December 2022.

Drafting on the FRC regime is not yet complete and will be subject to ministerial approval in 2023. The proposal includes the following recommendations made by Sir Rupert Jackson in the Jackson Report 2017, and the subsequent MoJ consultation:

• FRC will encompass most civil cases up to £100,000 in value, subject to certain exceptions

• a new Intermediate Track will be introduced, instead of extending the value covered by the current Fast Track to cover 'intermediate cases'

• provisions for four complexity bands in each of the Fast Track and the Intermediate Track will also be introduced

Details regarding the proposed rules will be published before the implementation in October 2023. Information relating to the FRC figures, as uprated for inflation since the Jackson Report, will be included.
