LNB news: MoJ announces entry into force of ECHR Protocol No 15

The Ministry of Justice (MoJ) has announced the entry into force of Protocol No 15 of the European Convention of Human Rights (ECHR), which is a major reform introduced by the Brighton Declaration, during the UK’s chairmanship of the Council of Europe’s Committee of Ministers

Lexis®Library update: The new Protocol No 15 introduced the following changes:

• inserting a reference to the principle of subsidiarity and the doctrine of margin appreciation

• shortening the time limit for which applications can be made to the European Court of Human Rights (ECtHR) from six to four months

• the removal of a rule preventing the rejection of an application that has not been considered by a domestic tribunal where the applicant has not suffered a 'significant disadvantage'

• removal of the right for parties to object to the decision of a Chamber of the Court to relinquish its jurisdiction in favour of the Grand Chamber

• raising the age limit for ECtHR judges from 65 to 70, to allow judges to serve their full nine- year term
