LNB NEWS: Amendments to the Civil Procedure Rules in force on 6 April 2023—The Civil Procedure (Amendment) Rules 2023

The Civil Procedure (Amendment) Rules 2023, SI 2023/105, made on 30 January 2023, have been published. 

Lexis®Library update: The majority of the amendments to the Civil Procedure Rules (CPR) made by SI 2023/105 come into force on 6 April 2023, with the exception of certain amendments to CPR 44 and CPR 61, which only apply to claims where the claim form is issued on or after 6 April 2023.

SI 2023/105 makes substantial amendments to the following:

●  CPR 19 – in relation to the addition and substitution of parties, and the service of notice on the Crown in Human Rights Act 1998 (HRA 1998) claims

●  CPR 20 – in relation to the service of additional claims

●  CPR 21 – in relation to the payment of costs and expenses

●  CPR 38 – in relation to the discontinuance of claims

Minor amendments are also made to CPR 17. 

Following the accession of King Charles III, various CPR amendments are also made to substitute for references to ‘Queen’s’ and ‘Her Majesty’s’, references to ‘King’s’ and ‘His Majesty’s.’
