Lexis®Library update: The updates include amendments to Practice Directions:
- 17 (amendment to statements of case);
- 19B (group litigation);
- 20 (counterclaims and additional claims);
- 21 (children and protected parties); and
- 38 (discontinuance),
as part of the ongoing work of the Civil Procedure Rule Committee to simplify the CPR.
Changes are also made to:
- CPR PD 6A (to address the effect of the decision in R (Tax Returned Ltd) v Commissioners for HMRC [2022] EWHC 2515 (admin);
- CPR PD 52D (in consequence of the Elections Act 2022);
- CPR PD 51O (the electronic working pilot scheme, which is extended for a further year to April 2024);
- CPR PD 51Y and CPR PD 55C (both brought in to deal with matters arising from the coronavirus pandemic) are revoked;
- CPR PD 19A (addition and substitution of parties) is revoked;
- CPR PD 19C (derivative claims) becomes new CPR PD 19A; and
- there are new CPR forms for derivative claims which replicate the forms of notice annexed to the legacy CPR PD 19C.
Further tidying up amends are made, including changes to reflect the accession of King Charles III.
The 153rd Practice Direction updates will come into force, variously, on 31st January 2023 and 6th April 2023. The updates were signed on 30 January 2023 but were published on the Ministry of Justice website on 7 February 2023 after entering partly into force.
