The High Court rejected claims by the Liberal Democrats and SNP that they were unfairly and unlawfully excluded from the ITV election debate between the Prime Minister and Leader of the Opposition this week
In a judgment delivered on the eve of the debate, Mr Justice Warby and Lord Justice Davis held the claims were ‘not realistically arguable’.
They held that ITV was not ‘exercising a public function’ therefore ‘not amenable to judicial review’ and the remedy available to the claimants was to lodge a complaint with OFCOM. Further, the decision ‘was a matter for the editorial judgment of ITV’.
