Secretary of State for Trade and Industry v Vohora [2007] EWHC 2656 (Ch), [2007] All ER (D) 256 (Nov)

For the purposes of the Company Directors Disqualification Act 1986, s 7(2) where the secretary of state applies for a disqualification order, “an application for the making of an order” has the same meaning as “the bringing of proceedings”. Accordingly, the claim is “brought” on the day that the letter of request and draft claim form are received and stamped by the court office.
