IPCO (Nigeria) Ltd v Nigerian National Petroleum Corporation [2008] EWCA Civ 1157, [2008] All ER (D) 197 (Oct)

To be enforceable under s 100 of the Arbitration Act 1996, it must be possible to enter judgment “in terms of the award”. However, the word “award” in this context should be construed to mean “the award or part of it”. Accordingly, a judge enforcing an award made in a New York Convention arbitration is entitled to order part enforcement of an award (see KnowHow this issue, p 1,522).
