Re Alitalia Linee Aeree Italiane SpA Connock and another v Fantozzi [2011] EWHC 15 (Ch), [2011] All ER (D) 104 (Jan)

Article 31(2) of the Insolvency Regulation, which was the source of the duty of co-operation, opened with the words “Subject to the rules applicable to each of the proceedings”, and other articles of that regulation envisaged that assets within the scope of secondary proceedings would be distributed in accordance with the local law.
