Steinfeld and another v Secretary of State for Education [2017] EWCA Civ 81, [2017] All ER (D) 158 (Feb)

The Court of Appeal held that the judge had erred in having found that the civil partnership regime, limiting it to same-sex couples, did not fall within the ambit of Art 8 of the European Convention on Human Rights. However, she had correctly held that the discrimination between the position of same-sex couples, who had the choice between two legal regimes recognising their relationship, and different-sex couples, who had only one, was at present justified.
