The Court of Appeal substantially upheld the judge’s decision on preliminary issues arising in civil claims involving allegations of ill-treatment, unlawful detention and unlawful killing of Iraqi civilians by British soldiers. However, the judge had erred in finding that there was a principle of extraterritorial jurisdiction under Art 1 of the European Convention on Human Rights to the effect that whatever and whenever a party to the Convention used physical force, it had to do so in a way that did not violate Convention rights.
