JIH v News Group Newspapers Ltd [2010] EWHC 2979 (QB), [2010] All ER (D) 207 (Nov)

In order for the court to give effect to Art 10 of the European Convention on Human Rights to the fullest extent, it was essential that editors and publishers have regard to the “duties and responsibilities” referred to in Art 10(2) itself. Those duties and responsibilities included a requirement that they complied with orders of the court, and that they took all necessary steps to ensure that journalists understand that necessity.
