An operator of a slaughterhouse did not have a right to challenge an adverse decision regarding quality made by an Official Veterinarian (OV) engaged by Food Standards Agency following the slaughter of an animal. The Court of Appeal, Civil Division upheld the decision of the Administrative Court in deciding that the function of the OV in deciding whether or not to apply a health mark was governed by directly applicable EU legislation, particularly Regulation (EC) 854/200.
