The claimant sought judicial review of the defendant secretary of state’s decision that its food product could not be classified as a food for special medical purposes. The Administrative Court determined three issues in the secretary of state’s favour. However, it referred a fourth issue, including as to the definition of “food for special medical purposes”, to the Court of Justice for the European Union.
