There were no specific conditions that needed to be satisfied before the power in r 14(1) of the Tribunal Procedure (Upper Tribunal) Rules 2008 (SI 2008/2698) could be exercised but it was subject to the overriding objective in r 2 of the rules which required the tribunal to deal with cases fairly and justly. The exercise of the power involved carrying out a balancing exercise between those factors that tended towards publication and those that would tend against.
