Responding to Ken Clarke’s proposals, Susan Brown, a director at Prolegal, says: “The proposals on ending recoverability of success fees and after-the-event insurance premiums are of course intended to save public money, primarily to the NHS, but also to local authorities.
It would be preferable if the government were open about this rather than couching its reasons in clichés about ‘legal costs out of all proportion’. Quite simply, these proposals will result in fewer people being able to bring compensation claims because affordable justice will not be available to people with complex or difficult personal injury and clinical negligence claims.”
