Re FC (a child) (care or supervision order: discretion) [2016] Lexis Citation 606, [2016] All ER (D) 11 (Dec)
The Family Court, in dismissing the local authority’s appeal, held that the judge’s conclusion, in the exercise of her discretion, that a care order, rather than a supervision order, had been the appropriate order to make had been a decision that fell well within the generous ambit within which reasonable disagreement was possible. In all of the circumstances, it was impossible to conclude that the judge’s decision had been wrong.
