The judge had not erred in ordering the appellant’s extradition to Germany to face trial for the failure to pay social welfare contributions or social security contributions in 2007 and 2008. In particular, the Administrative Court held that the appellant’s prosecution for the offences was not barred under the Extradition Act 2003 s 12, as it could not be said that the alleged facts were the same or substantially the same as the facts which had given rise to the appellant’s earlier offences.
