Environmental Permitting (England and Wales) (Amendment) Regulations 2011 (SI 2011/Draft)

Amend the Environmental Permitting (England and Wales) Regulations 2010, SI 2010/675 (“the Environmental Permitting Regulations”).

Provide a modernised and transparent framework for the regulation of radioactive substances and demonstrate clearer compliance with Council Directive 96/29/EU.

Modify the situations in which permits will be required, by amending what is defined as radioactive material or waste (and hence are subject to regulation) and by consolidating and revising the existing exemptions from the requirement to hold permits.

Transpose provisions of the IPPC Directive (Council Dir 2008/1/EC) and the Water Framework Directive (Council Dir 2000/60/EC) that have been inserted by the Carbon Capture and Storage Directive (Council Dir 2009/31/EC).
