Blackwood v Birmingham & Solihull Mental Health NHS Foundation Trust [2016] EWCA Civ 607, [2016] All ER (D) 168 (Jun)

 

The Court of Appeal, Civil Division, allowed the appellant’s appeal against a finding of the employment tribunal that the effect of s 56(5) of the Equality Act 2010 was that it lacked jurisdiction to hear her claim for sex discrimination against an NHS foundation trust with which she had been allocated as part of her studies. Section 56(5) of the Act did not operate to deprive the employment tribunal of jurisdiction, and hence the case would be remitted to the employment tribunal for a determination of its merits.
