ITV Broadcasting Ltd and other companies v TV Catchup Ltd [2011] EWHC 1874 (Pat), [2011] All ER (D) 175 (Jul)

Section 2(2)(b) of the European Communities Act 1972 was not to be approached restrictively. The primary objective of any legislation implemented under that section had to be to bring into force laws which, by treaty, the United Kingdom had agreed to make as part of her laws. Section 2(2)(b) allowed for legislation which was not necessarily for the implementation of Council Directive (EC) 2000/29 (on the harmonisation of certain aspects of copyright and related rights in the information society), which was consistent with the Directive but which did not have the same purpose.
