Absolute Lofts South West London Ltd v Artisan Home Improvements Ltd and another [2015] EWHC 2608 (IPEC), [2015] All ER (D) 77 (Sep)

The Intellectual Property Enterprise Court awarded damages for admitted breach of copyright by the defendant in respect of use of photographs from the claimant’s website. The claimant was awarded damages under the user principle and additional damages pursuant to s 97(2) of the Copyright, Designs and Patents Act 1988. Further, the claimant claimed damages under Art 13(1) of Directive (EC) 2004/48 on the enforcement of intellectual property rights (the Enforcement Directive).
