The unitary patent and Unified Patent Court, which are being developed and which would sit outside EU law and EU institutions, would allow inventors to apply for a single patent to protect their invention in all participating states. It has been reported that the UK will no longer seek to participate. However, the government has not made a statement.
Lord Morris, chair of the EU Justice Sub-Committee, has written this week to the minister responsible, Amanda Solloway MP, in the Department for Business, Energy and Industrial Strategy, asking her to clarify the government’s position.
