The Court of Appeal, Civil Division, has given guidance on changes to the CPR in respect of applications to extend time.

The claimants brought proceedings for defamation. Their action was dismissed in 2012, and they were ordered to pay costs, subject to detailed assessment if not agreed. The judge also ordered the claimants to pay £15,000 on account by 1 June 2012. The claimants paid part of that sum in time, but not the full amount until early October 2012. The defendant’s bill of costs totalled £86,500. She had previously indicated that it would be £72,600. The claimants’ points of dispute were to be served by 14 May 2013. The claimants asked for a 21 day of extension of time
