Chancellor confirms process for remote witnesses abroad

Sir Julian Flaux, Chancellor of the High Court has issued a practice note confirming the process to be followed for witnesses giving evidence remotely from a foreign jurisdiction.

It highlights that it is up to the party calling the witness to ensure any necessary permission from the local court or other authority in the foreign jurisdiction has been obtained in good time and to inform the court of this fact.

Sir Julian directed that this permission should be obtained by the date of the pre-trial review or, if no pre-trial review, by the time of filing the pre-trial check list.
